1. Agreement

These Terms are between you and The Nocturne Collective (a sole trader business) ("we", "us"), and govern your use of the Locality app. By using Locality, you agree to these Terms. If you don't agree, please don't use the app.

2. Who can use Locality

You must be at least 13 years old to use Locality and to create an account. By using the app you confirm you meet this requirement.

3. What Locality is

Locality provides climate profiles and general husbandry guidance for reptile, amphibian, and invertebrate species, built from historical weather data, along with tools to record and track your own animals. It is an information and record-keeping tool.

4. Important: guidance, not veterinary advice

Please read this carefully.

Locality provides general, informational guidance only. It is not veterinary advice, and it is not a substitute for the judgement of a qualified veterinarian or experienced specialist who can assess your specific animal.

To the fullest extent permitted by law, we are not responsible for outcomes arising from your reliance on the app's guidance.

5. Your account

If you create an account, you're responsible for keeping your login details secure and for activity under your account. Provide accurate information, and let us know if you suspect unauthorised access. You can delete your account at any time from within the app.

6. Acceptable use

You agree not to: use Locality for any unlawful purpose; attempt to disrupt, reverse-engineer, or gain unauthorised access to the app or its systems; scrape or bulk-extract its data; or submit content that is unlawful, false, harmful, or infringes others' rights.

7. Community submissions

Locality lets you submit species information. When you submit content, you confirm you have the right to share it, and you grant us a non-exclusive, worldwide, royalty-free licence to use, store, adapt, and display it within the app. We may review, edit, decline, or remove submissions at our discretion, including anything that conflicts with our welfare-first principles (for example, we do not host content that promotes breeding purely for aesthetics). You remain responsible for what you submit.

8. Intellectual property

The app, its design, branding ("The Nocturne Collective", "Locality"), and its content (other than your own data and submissions) belong to us or our licensors. You may use the app for your own personal, non-commercial animal-keeping. You keep ownership of the animal records and content you create.

9. Privacy

Your use of Locality is also governed by our Privacy Policy privacy policy, which explains what we collect and how we handle it.

10. Availability and "as is"

Locality is provided "as is" and "as available". It is under active development and may change, have errors, or be unavailable at times. We don't warrant that it will be uninterrupted, error-free, or that its data is complete or accurate for your particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential loss, or for any harm to animals, arising from your use of, or inability to use, Locality or your reliance on its content. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).

12. Paid features

Locality is currently free. If we introduce paid features in future, we'll present the price and any additional terms clearly before you buy.

13. Changes

We may update these Terms as the app evolves. We'll update the "Last updated" date and, for significant changes, tell you in the app. Continuing to use Locality after a change means you accept the updated Terms.

14. Termination

You may stop using Locality and delete your account at any time. We may suspend or end access if you breach these Terms or misuse the app.

15. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, unless local law grants you other rights.
